Video accessibility for Oklahoma and Tulsa TGOV

What applies to Tulsa and TGOV today
Unlike Colorado, Oklahoma has no state statute equivalent to HB21-1110 for municipalities. The Oklahoma EITA Act (62 O.S. § 34.28) and OAC Title 260, Chapter 15 ICT standards apply to state agencies only, not the City of Tulsa or TGOV.
For Tulsa (~413,000 residents), the primary hooks are ADA Title II (42 U.S.C. § 12132; 28 CFR §§ 35.130, 35.160) and the DOJ web rule at 28 CFR § 35.200, which requires WCAG 2.1 Level AA for web content and mobile apps, including video. Compliance deadline: April 26, 2027 (extended from April 2026).
Tulsa codifies ADA obligations locally at TRO Title 5, Chapter 1, Section 111, which prohibits disability discrimination in City services, programs, and activities and requires reasonable modifications and auxiliary aids where needed.
Tulsa ADA Transition Plan acknowledges the TGOV gap
The City’s March 2023 ADA Self-Evaluation and Transition Plan (§ 5.1.4) states that meetings aired on cable via TGOV are presently not closed captioned, and recommends exploring captioning for televised and City-produced audiovisual content. Section 5.1.5 requires City-maintained websites, including video, to use accessible elements such as captions where needed and to maintain Section 508-aligned compliance.
That plan is policy, not a statute, but it gives Council and TGOV staff a documented baseline when budgeting captioning remediation.
The compliance story directors can defend
TGOV cable carriage on Cox channel 24 is largely exempt from FCC broadcaster caption license thresholds. The cable operator holds the license, not the City access channel.
Your web simulcast is not exempt. When council video is published on tgovonline.org, embedded on tulsacouncil.org, streamed through Granicus, or shared on Facebook, ADA Title II effective-communication requirements apply. Itemize uncaptioned live streams and archives, estimate remediation cost, and map expenses to ADA compliance or PEG funding where franchise language allows.
Statutes and rules for tulsacouncil.org
tulsacouncil.org is the City Council’s official site. Council meeting video is hosted on Granicus (tulsa-ok.granicus.com) and linked from tgovonline.org. No Tulsa ordinance names tulsacouncil.org specifically, but the following apply to council web content and archived meeting video:
TRO Title 5, § 111
Prohibits disability discrimination in City services, programs, and activities. Requires reasonable modifications and auxiliary aids (including interpreters and similar accommodations) for qualified individuals with disabilities. Complaints go to the ADA Compliance Official in Human Rights / Resilience and Equity.
City accessibility policy
The City’s accessibility policy requires City web pages, including council pages, to meet Section 508 and, where possible, W3C accessibility standards. The ADA Transition Plan (§ 5.1.5) extends that obligation to any City-maintained website, including captions on embedded video.
Council rules (video retention)
Tulsa City Council rules require video recordings of regular meetings to be retained at least two years and compliance with the Oklahoma Open Records Act. These rules govern retention and public access; they do not require captions, but archived video on Granicus remains ADA-covered web content once published.
Open Meeting Act
25 O.S. § 307.1 requires videoconference public meetings to be recorded and 25 O.S. § 311 governs public notice. Neither statute mandates captions or transcripts. Real-time public access during the meeting is required; a later recording alone does not satisfy open-meeting obligations.
TGOV ordinance and PEG franchise authority
TRO Title 12, Chapter 7 (Tulsa Government Television, Ordinance 22305) governs TGOV operations and the coordinating committee. It does not set caption requirements. At the state level, 11 O.S. § 22-107.1(D) allows Tulsa to require PEG channel capacity, facilities, or financial support in cable franchise renewals. Confirm PEG fund balances and permitted uses in the Cox/Tulsa franchise agreement.
Title 12, Chapter 7, Section 701 (TGOV policies) was amended in 2025 alongside human-rights ordinance updates; review the current ordinance text for any operational changes affecting broadcast or web distribution.

PEG and cable franchise fees
PEG support flows through the Cox cable franchise under Title 11, Chapter 12 and state law at 11 O.S. § 22-107.1. Franchise language and fund restrictions vary. Confirm whether captioning CapEx (encoder or audio path upgrades) or OpEx (ongoing captioning subscriptions) is eligible with the Council Administrator or franchise administrator before budgeting.
ADA compliance budget lines
Where PEG OpEx is restricted, captioning for tgovonline.org, Granicus archives, and tulsacouncil.org embeds may be budgeted as a general ADA Title II remediation obligation. The April 2027 WCAG deadline gives Council a defensible FY line even where cable carriage rules differ.
